Due to California Regulations, DTSC is not authorized to grant extensions.

The Off-Site Identification Form is not required for the 2012 or 2013 AFR.



What is the purpose of the AFR?

The Department of Toxic Substances Control (DTSC) holds facilities that handle hazardous wastes to high standards of operation. 

DTSC collects and maintains information about the Cradle-to-Grave lifecycle of hazardous waste generated, managed, transported, and all the final disposition of hazardous wastes within California.

The Information gathered by the AFR is used to analyze hazardous waste management activities in the State. DTSC uses the data to identify trends and to measure the quality of environmental protection offered to the citizens of California.



Who must file the Annual Facility Report?

A Treatment, Storage, or Disposal Facility (TSDF) is required to file the Annual Facility Report (AFR) pursuant to the California Code of Regulations, Title 22, Division 4.5:

  • Chapter 14, Article 5, Section 66264.75
  • Chapter 15, Article 5, Section 66265.75
  • Chapter 20, Article 3, Section 66270.30(l)(9)

Who is NOT required to file the Annual Facility Report?

Any TSDF that does not meet the above criteria must file an Exemption Request.

2012 AFR Exemption Request Form



Requirements:

TSDF's are required to report all RCRA and State hazardous waste activities in order to maintain regulatory compliance in accordance with the AFR.
  

When is the AFR due?

The AFR must be postmarked no later than March 1st  of every year covering activities conducted the previous year. Please, DO NOT fax completed reports. 
  

  
Fees:

No fees are required for completing the AFR. However, failure to comply with State regulations regarding Annual Reports may result in fines and penalties.



Disclosure:

This year, DTSC will mail out courtesy notification letters to facilities that are required to file the 2012 Annual Report. However, DTSC is neither required nor obligated to notify facilities of when to report. It is the responsibility of all facilities to obtain current forms and reporting information. Furthermore, it is the facilities responsibility to submit reports and manage reporting deadlines.

As of June 1, 2011, the Waste Reporter software is no longer available for distribution or support. Consequently, the software will not be available for preparation of Biennial Hazardous Waste reports for the 2011 reporting year.
