REA Laws and Regulations

The statutes governing the REA program and the regulations implementing the program (California Code of Regulations, Title 22, Division 4.5, Chapter 52, sections 69200 - 69214) are available on this Web site and from the Office of Administrative Law at http://www.calregs.com/. Environmental Quality Assessment Act
This section of the California Health and Safety Code forms the basis for the Registered Environmental Assessor program. In addition to other requirements, the statute specifies the minimum standards for registration, sets fees, and defines certain enforceable actions.


Private Site Management
This section of the Health and Safety Code defines the actions and activities conducted pursuant to Private Site Management. This statute formed the basis for the REA II registration.


Brownfields Investigation and Cleanup
This recently enacted bill authorizes local governments to investigate and cleanup small parcels of property contaminated by hazardous waste. The bill requires the development of screening values and a guidance document to assist communities, developers and local governments with procedures used for cleaning up hazardous waste. The REA II is included as a qualified individual for conducting these activities.


Cleanup Loans and Environmental Assistance to Neighborhoods (CLEAN) Program
This new program is intended to stimulate the redevelopment of Brownfields by making funds available to individuals desiring to investigate and cleanup Brownfields in urban areas. Regulations implementing this statute define the required actions and activities necessary for loan applicants to secure funding. The REA II is included as a qualified individual for conducting or directing the investigation and cleanup of these sites.


Schoolsite Environmental Assessments
This section of the Education Code defines the actions and activities conducted by an REA II to determine whether a proposed or acquired schoolsite is impacted by hazardous substances or materials.


Air Toxics Risk Reduction Audits and Plans
This program requires that facility operators conduct an airborne toxic emissions audit and develop a plan to implement emissions reduction measures that will result in the reduction of facility emissions. Ongoing emissions inventory updates are required as specified by the air quality management district. The Registered Environmental Assessor is included as an individual qualified to prepare reports pursuant to the section.


Source Reduction Evaluations and Plans
This program requires facilities that are generating hazardous waste to conduct evaluations and develop plans to reduce the production of these wastes. Facility operators are required to submit reports documenting the performance of the source reduction measures. The Registered Environmental Assessor is included as an individual qualified to prepare reports pursuant to the section.
