Photovoltaic Modules - Universal Waste Management Regulations Update

DTSC will seek to notice the Photovoltaic Module (PV module) –Universal Waste Regulations in Summer 2018 to provide time for DTSC to seek and obtain authorization for its Universal Waste regulations from the United States Environmental Protection Agency (U.S. EPA).  With U.S. EPA's authorization, DTSC will be able to include both federally regulated PV modules as well as state regulated PV modules in its regulations.  Inclusion of both will provide the benefits of the universal waste regulations to all types of PV modules, and allow producers of waste PV modules to avoid difficult and costly waste determination procedures. 

DTSC has identified federal authorization for its Universal Waste regulations as a priority, and is working with U.S. EPA to obtain authorization for its Universal Waste regulations.  You can access more information about state authorization by U.S.EPA under the federal hazardous waste program at this link.  As the authorization moves forward, DTSC will proceed with proposed PV modules regulations that will address both RCRA and non-RCRA PV modules.  

DTSC appreciates your patience and your continued interest and engagement in its rulemaking efforts.  DTSC will update its web site to include the status of both its Universal Waste regulations authorization efforts and the PV module rulemaking, as both efforts proceed.

The Law:

On October 1, 2015,SB 489 (Monning, Chapter 419) was enacted to add section 25259 to Health and Safety Code, Division 20, Chapter 6.5, Article 17, which authorizes the Department to adopt regulations to designate end-of-life photovoltaic modules that are identified as hazardous waste as a universal waste and subject those modules to universal waste management.


PV Modules (also known as solar panels) - Universal Waste Management Regulations Development had workshops in July 2016 and August 2017.  The purpose of the workshop was to provide the public with an opportunity to review the draft proposed regulations and provide feedback prior to DTSC beginning a formal rulemaking process on the management of end-of-life PV modules.
